Litigation is Representation

Synonymous with enforcement, litigation includes all manner of legal representation—for either the plaintiff or defense—necessary to ensure that patents, trademarks, copyrights, and the intellectual property they protect retain their dominion. IP litigation typically occurs in four major arenas: the U.S. District Court, which provides judicial oversight for cases related to patents, trademarks, and copyrights; the U.S. Court of Appeals for the Federal Circuit and the Patent Trial and Appeal Board, both of which see cases involving patents and related legal considerations; and the Trademark Trial and Appeal Board, which specializes in trademark-related cases. Antoinette M. Tease, PLLC has represented individuals and entities extensively in each of these arenas, handling hundreds of cases as lead counsel, including Site 2020 Inc. v. Superior Traffic Services LLC and Trebro Manufacturing, Inc. v. Firefly Equipment, LLC, both of which were successfully argued and garnered national attention.

Notable Decisions

Site 2020 Inc. v. Superior Traffic Services, LLC, 2023 U.S. Dist. LEXIS 99704 (March 27, 2023) (where Tease represented the defendant, the court dismissed the plaintiff’s patent infringement claims based on discovery misconduct)

Pinnacle Construction v. Pinnacle Roofing LLC, Case No. 18-CV-35-SWS (D. Wyo. 2018) (where Tease represented the plaintiff, the court granted the plaintiff’s motion for a preliminary injunction in a trademark infringement case)

Trebro Manufacturing, Inc. v. Firefly Equipment, LLC, 748 F.3d 1159 (Fed. Cir. 2014) (where Tease represented the patent owner, the court held that the lower court abused its discretion in not entering a preliminary injunction in favor of the patent owner)

Credit Suisse First Boston v. Credit Suisse International Holding Corp. et al., Case No. CV 97-42-H-CCL (D. Mont. 1997) (where Tease represented the plaintiff, the court entered a preliminary injunction prohibiting the defendants from using the “Credit Suisse” mark)
